CONTRACT + TERMS OF SERVICE
Usage
This contract confirms the licensing (not ownership) of the Work from the Artist. Artist keeps all rights. Client has non-exclusive usage rights for promotional purposes.
Ai
Artwork cannot be used to create any derivative versions or interpretations of the Work through generative-AI software. Artwork shall not be fed into Ai even if training is disabled. Client must advise team and third-party collaborators to follow policy.
Edit
If Client requires changes to work, Artist reserves the right to be first to edit the Work.
Merch
Artist is given/sent a copy of each produced piece of merchandise upon first round of production.
Pricing reflects unchanged imagery, editing images for merch incurs $25/hour fee, 1 hour minimum.
Payment & Cancelation Policy
Deposit is 50% of estimate, work will start once payment is received and all information and imagery is delivered to Artist.
High resolution file(s) will be sent after payment is received in full.
If Art is ‘shelved’, Artist retains all rights to Artwork and rights to document the work to Portfolio, Blog, and Socials within a year after project has been postponed.
$40/hour fee will be collected when client decides to cancel project or put project on hold for over a month: net/30.
Posting & Signature
Collaborative posts are preferred.
Artist must be tagged when project is posted, in caption as well as on photo.
Artist’s work is signed and logo/watermark cannot be modified or cropped out without confirmed request.
Sketches
Artist retains ownership of the sketches created for finalized work. Client may not share sketches on social media or create derivative work without Artist's consent.
Turnaround Time
Consider your merch drop/upload date.
2 weeks (14 days) minimum need to complete work once time client has turned in all info + imagery. Extra time is appreciated.
Once Artist turns in work for critique, client must return full notes within 24 hours or each additional day's wait-time will be added to 2-week turn around. IE: client takes 6 days to reply with comments means 14 day project has now increased to 19 days (14 days + 5 = 19 days).
Less than 14 day turnaround will incur a rush-fee of 1.5 times the estimated costs shown above.

Proceeding with this commission is acknowledgement of adherence to this contract. Non-refundable deposit initiates assignment. Deposit will be subtracted from final invoice.
